Booking terms and conditions

Quick Summary

Booking & Deposits: A 50% 'non refundable' booking deposit is required at time of booking and the balance EIGHT weeks before arrival.

If a booking is made within the eight week period the FULL amount is required at the time of booking.

Refundable Deposit: A £300 insurance excess damage protection deposit is refundable on inspection of property. The breakages deposit will be returned promptly after your visit subject to a satisfactory property inspection.

Exchange Rate

The booking published rate is calculated in Sterling GBP. Other currency options are for reference only and the actual exchange rate varies daily. Payment exchange is determined on the day of payment by the banks

Cancellation Refunds:

4-8 weeks 50% of rate refunded

2-4 weeks 25% of rate refunded

Less than 2 weeks no refund

It is strongly recommended to take out adequate Travel Insurance to cover your cancellation costs.

Turnarounds: The villa is available after 3 pm on the day of arrival and is to be vacated by 10am on day of departure. This may be extended by agreement and at a cost of €10 per additional hour to a maximum of 5 hours. This is to allow us to prepare the villa for the next guests.

Cancellation or Amendment by us, the Owner

In the unlikely event that we or the owners have to cancel the accommodation booking, we will either offer alternative 'comparable' accommodation or by request, your full booking and any deposits will be refunded immediately. If the alternative is of a lower price than that originally booked the difference (if already paid by you) will be refunded. If the alternative is more expensive you will have to pay the difference; or c) cancel your booking completely.

Your holiday contract

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. You must be at least 21 years old to make a booking with us. Your contract is with the property owner whose details are outlined on the webpages and in the booking form sent by email or post. A confirmation invoice will been issued to you on payment.

Your financial protection

For peace of mind when booking your payments are fully protected under the Consumer Credit Act 1974. Other countries have similar acts.

TOTAL PEACE OF MIND & SSL GEOTRUST SECURITY CERTIFICATION

You have total control over your payments and altering payment options. All transactions utilize 128 bit encryption, the highest level of security credit card companies can offer. The presence of SSL (Geotrust Certificate) means you can rest assured that communications (e.g. credit card numbers) between your browser and this site's web servers are private and secure when the SSL session is activated.

Published accommodation rates

We reserve the right to alter the prices of any of the holidays shown in our brochure. You will be advised of the current price of the holiday that you wish to book before your booking is confirmed.

Breakage deposit (insurance excess)

Our luxury properties will require a REFUNDABLE breakage deposit paid pre-departure. General wear & tear is covered by your booking fee.

Damage caused by willful and negligent behavior: In accepting these booking terms (the responsible person named on the booking confirmation) hereby agrees to pay for damage caused for willful and negligent behavior by the entire guest party. The refundable deposit will cover minor damage caused by negligence or intention that are not covered by insurance. gauk Villas maintenance staff will repair any damage as efficiently and reasonably as possible and will return any balance from the cost of a repair.  If the cost of accidental damage exceeds £300 in the first instance an insurance claim will be made. In the second instance the 'responsible person' agrees to pay for the full cost of the damage exceeding the insurance excess deposit amount. The 'responsible person' agrees to a charge being not exceeding the damage cost being made to their credit card/Paypal account on invoice, or will make the payment locally or an invoice will be sent to to the UK address which will be paid within 14 days of date of creation.

Confirmation

Please check your confirmation invoice, tickets, final itinerary and all other documents you receive from us, immediately on receipt. You must contact us straightaway if any information appears to be incorrect as it may not be possible to make changes later. We are responsible for providing the holiday we have confirmed to you. If you cancel or alter your booking later on, you may have to pay an amendment charge depending on published rates. We reserve the right to refuse your booking. If we do this we will refund any money already paid to us.

If you change your booking

If, after our confirmation invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking.

If you cancel your holiday

To cancel the entire holiday or any component, the Party Leader must either write, or email. Contact details are stated on your booking confirmation. Cancellation takes effect on the date we receive your notice. If you cancel after we confirm your booking, you must compensate us for losses, as we incur costs from the moment you make the booking. The closer your cancellation is to the departure date, the less likely we are to recover the costs by re-selling the holiday or components at the original price. Our cancellation charges therefore increase as the departure date approaches, as shown below. Also note the ‘Exception’ described below/overleaf which may apply in addition to the scale of charges. If you have to cancel for a reason covered by your insurance policy, you should be able to recover the cancellation charges. Claims must be made directly to the insurance company concerned. .

Delays

We are unable to accept any liability for any delay to your flight, ferry crossing or train journey whether the delay or cancellation is caused by adverse weather conditions, the action of air traffic controllers, the action of port, airport authorities or governments, the rescheduling of times by the carrier, mechanical breakdown, strike or industrial action or otherwise. In such circumstances you may be able to make a claim under your insurance policy.

Your accommodation

Management access and the property

We or the owners reserve the right to visit the property at any time to undertake essential maintenance work, pool cleaning, gardening, routine inspections and emergency repairs.

Additional overnight guests other than those booked are strictly prohibited and will be asked to vacate by resort staff, accommodation supplier or other person in authority. In some cases a fee will be raised for the person if they have used stayed overnight. On departure you should leave the accommodation in a reasonably clean and tidy condition so that we can efficiently prepare it for our next guests. If additional cleaning has been necessary, a charge will be made locally or an invoice will be sent to you on your return.

Special requests

If you have a special request that does not form part of the arrangements described on the website or in our brochure please inform us in writing. We will do our best to comply but cannot guarantee to do so and it will not form part of our contracted obligations.

Holiday insurance

Adequate insurance is essential.

Our liability to you

We accept responsibility for ensuring that your accommodation arrangements which you book with us are supplied as described on the website or in our brochure. If any part of your accommodation arrangements are not provided as promised, we will pay you appropriate compensation if this has affected the enjoyment of your accommodation arrangements.

Local activities, facilities and excursions

Some facilities, activities and excursions detailed on the website could involve an element of risk. These activities, facilities and excursions are provided for information only and are neither run nor controlled by gauk or the accommodation owner. Usually these locally paid for activities, facilities and excursions will be subject to local law and jurisdiction. The discretion to partake in any such activities, facilities, or excursions is entirely at your own risk. You are responsible for taking sensible precautions for your own safety and for the safety of any children or family members for whom you are responsible. Please liaise with the supplier of the facility, activity or excursion for the Terms and Conditions of your activity, facility or excursion which will govern your contract.

If you have a complaint

If you have cause for complaint whilst on holiday or travelling to your destination, this must be brought to the attention of the accommodation owner/representative representative or relevant supplier immediately so that action can be taken at the time to rectify the problem. Should the representative/local agent/supplier or villa management company be unable to resolve the matter, details of the complaint must be notified to gauk Villas in writing within 28 days of the end of your holiday. Any claims received outside this period cannot be considered as if you do not tell us about your complaint promptly, it may prove difficult to investigate or rectify your complaint.

Behavior

Please note that in some instances residents live close by. At all times during your holiday, you are expected to have consideration for third parties. If in 'exceptional' circumstances you are or appear to be behaving in such a way as to cause, or to be likely to cause, danger, distress, annoyance or damage to property, either ourselves or the supplier concerned may terminate your holiday arrangements. In this situation, we will have no further liability to you and will not be responsible for meeting any expenses you incur as a result, making any refund or paying any compensation. In addition, you will be responsible for any expenses we incur as a result of your behavior.

Passports, visas and health requirements

The airline, ferry or train operator, will refuse travel if you do not have a valid passport, visa and entry permit. We are not obliged to help you if you are refused travel. Your passport and travel documents must be intact: you may not be able to travel if they are damaged or have been tampered with. Passport, visa and health requirements are subject to change and it is your responsibility to check the up-to-date position in good time before departure.

Data protection policy

In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, any special needs/requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your arrangements such as, villa management companies/villa owners, transport companies etc. Your data controller is: gauk Villas

Accuracy of Information

All information supplied is correct and accurate to the best of our knowledge. We cannot, however, be held responsible for changes made that we are not made aware of or are indeed beyond our control. All distances and measurements given are approximate and should be used as a guide only.

Public services and liability

We or the owners cannot accept any liability for the breakdown of public services including water and electricity nor in respect of any equipment, plant machinery or appliances in the property. However the villa owners/management will do their utmost to limit the impact of any such eventuality. For example, if a dishwasher fails it will be repaired or replaced at the earliest opportunity.

Limitation of liability

All users agree that Auctions International Ltd gauk villas.com and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any punitive, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, or other intangible losses (even if Auctions International Ltd has been advised of the possibility of such damages), resulting from:  the use or the inability to use the gauk Villas service;  the cost of procurement of substitute goods and services;  statements or conduct of any third party; or any other matter relating to the gauk Villas Service. Users accept that they are using gauk Villas accommodation entirely at their own risk with absolutely no liability on the part of gauk Villas or villa owners whatsoever.
